1. To approve the attached qualifications assessment center to conduct an independent qualification assessment in the form of a professional examination.

2. The Ministry of Labor and Social Protection of the Russian Federation shall provide explanations on the application of the independent assessment of qualifications by the qualifications assessment center in the form of a professional exam, approved by this resolution.

1. These Rules establish the procedure for the qualifications assessment center to conduct an independent assessment of qualifications in the form of a professional examination.

2. The concepts used in these Rules mean the following:

"assessment tools for conducting an independent assessment of qualifications" - a set of tasks, assessment criteria used by the centers for assessing qualifications during the professional examination;

"register of information on the conduct of an independent assessment of qualifications" - an information resource to ensure the conduct of an independent assessment of qualifications;

"council for professional qualifications" - a governing body empowered in accordance with the Federal Law "On independent assessment of qualifications" with the authority to organize an independent assessment of qualifications for a specific type of professional activity;

"applicant" - an employee or applying for a certain type of implementation labor activity a person who applied, including in the direction of the employer, to the qualifications assessment center to confirm their qualifications in the manner prescribed by the Federal Law "On independent assessment of qualifications" and these Rules;

"Qualifications Assessment Center" - a legal entity carrying out in accordance with the Federal Law "On Independent Assessment of Qualifications" activities to conduct an independent assessment of qualifications.

3. The professional examination is conducted by the qualifications assessment center to confirm that the qualifications of the applicant comply with the provisions professional standard or qualification requirements established federal laws and other regulatory legal acts of the Russian Federation.

4. In order to inform citizens and organizations about the conduct of a professional exam, the following information and documents are posted on the official websites of the qualifications assessment center and the council for professional qualifications in the Internet and in the register of information on the conduct of an independent assessment of qualifications:

a) the names of qualifications and the requirements for qualifications provided for in these Rules, for compliance with which the qualifications assessment center conducts an independent assessment of qualifications;

b) the validity period of certificates of qualifications for the relevant qualifications;

c) a list of documents required for passing the professional exam for the relevant qualifications;

d) a set of tasks that are part of the assessment tools for an independent assessment of qualifications;

e) postal addresses, addresses Email, addresses of the official sites of the qualifications assessment center and the council for professional qualifications in the information and telecommunication network "Internet";

f) the addresses of the places of the professional examination;

g) a sample application of the applicant for a professional examination;

5. The professional examination is carried out at the initiative of the applicant at the expense of the applicant, other individuals and (or) legal entities, or by the direction of the employer at the expense of the employer in the manner prescribed by labor legislation.

6. A person at whose expense a professional exam is being conducted (applicant, employer, other individual and (or) legal entity) pays for the professional examination services on the basis of an agreement on compensated provision of services concluded between him and the qualifications assessment center (hereinafter - contract).

7. To pass the professional exam, the applicant personally or through a legal representative submits to the qualifications assessment center on paper or electronic media a set of documents, including (hereinafter referred to as a set of documents for the applicant):

a) a statement on the conduct of a professional exam indicating the qualifications for which he wants to pass a professional exam, while in the application the applicant consents to the processing of his personal data contained in the application, as well as in the documents and materials attached to it;

b) a copy of the passport or other identity document of the applicant;

c) other documents required for the applicant to pass a professional examination for the relevant qualifications, information about which is contained in the register of information for conducting an independent qualification assessment.

8. In order to ensure the conduct of a professional examination, the qualifications assessment center carries out:

a) acceptance and registration of a set of documents of the applicant;

b) consideration and informing the applicant or legal representative of the results of consideration of the applicant's set of documents;

c) determination and agreement with the applicant or legal representative of the date, place and time of the professional examination;

d) conducting a professional exam;

e) registration of the results of the professional examination;

f) registration and issuance of a certificate of qualification to the applicant or legal representative (if the applicant receives an unsatisfactory mark based on the results of the professional examination, the registration and issuance to the applicant or legal representative of the conclusion on the applicant's passing the professional exam, including recommendations for the applicant).

9. The qualifications assessment center, within 10 calendar days after receiving the set of documents of the applicant, informs the applicant or legal representative in the manner specified in the application for holding a professional exam, about the results of consideration of the application and the set of documents of the applicant and agrees with the applicant or legal representative of the date, place and time conducting a professional exam, and also informs the applicant or legal representative about the procedures for conducting a professional exam.

If the professional examination is carried out on the employer's direction, the qualifications assessment center coordinates with the employer the date, place and time of the professional examination.

If the applicant or legal representative has submitted an incomplete set of documents for the applicant, the qualifications assessment center informs the applicant or legal representative about this.

10. The applicant is allowed to pass the professional exam on the basis of an identity document.

11. The professional examination is carried out in accordance with the assessment tools for the independent assessment of qualifications for the relevant qualifications, approved by the Council for Professional Qualifications.

12. Representatives of the Ministry of Labor and Social Protection of the Russian Federation and the Council for Professional Qualifications may be present during the professional examination.

13. An applicant who fails to appear for a professional examination is allowed to take a professional examination in the cases and on the conditions stipulated by the contract.

14. The professional examination is considered to be successfully passed if the applicant achieves a result that meets the assessment criteria determined by the assessment tools for conducting an independent assessment of qualifications.

15. The results of the professional exam are drawn up by the protocol of the expert commission (hereinafter referred to as the protocol).

The Qualifications Assessment Center, no later than 7 calendar days after the completion of the professional exam, sends the protocol, copies of the applicant's sets of documents and other materials for the professional examination to the Council for Professional Qualifications.

16. Council on professional qualifications on the basis of the protocol, copies of sets of documents of the applicant, test results, photo and video materials and other materials of the professional examination no later than 14 calendar days after the completion of the professional examination:

a) verifies, processes and recognizes the results of an independent assessment of proficiency;

b) makes a decision on the issuance of a certificate of qualifications or an opinion on the passage of a professional exam to the applicant or legal representative by the qualifications assessment center;

c) sends to the autonomous non-profit organization"National Agency for the Development of Qualifications" to enter in the register information on the conduct of an independent assessment of qualifications, information on certificates of qualifications and conclusions on the passage of the professional exam.

17. The Center for Qualifications Assessment, based on the decision of the Council on Professional Qualifications based on the results of the applicant's passing the professional exam, no later than 30 calendar days after the completion of the professional exam, draws up and issues a certificate of qualification to the applicant or legal representative issues a conclusion on the passage of the professional exam, including recommendations for the applicant) or sends a certificate of qualification (conclusion on the passage of the professional exam) to the address of the applicant specified in the application for the professional examination.

18. If the agreement provides for informing the person at whose expense the professional exam was carried out (employer, other natural and (or) legal entity) about the results of the professional exam, the qualifications assessment center sends to such person in electronic form a copy of the certificate of qualification (in if the specified certificate is issued) or a copy of the conclusion on the passage of the professional exam by the applicant (if the specified conclusion is issued).
