What are the guarantees of intangible nature for young specialists. What guarantees are given to young specialists

The state and regional authorities establish benefits for young specialists, whose task is to stimulate the working capacity of graduates of primary, secondary and higher educational institutions to municipal and state organizations.

In this article, we will analyze in detail the following questions: what are the benefits for young professionals; what is the procedure for granting benefits; the concept of the status of a young specialist; what are the conditions for obtaining the status of a young specialist.

Who is recognized as a young specialist under the Labor Code of the Russian Federation

Today, at the federal level, the status of a young specialist and the provision of the prescribed benefits are practically not regulated. There is one normative legal act that contains a similar provision - Art. 70 of the Labor Code of the Russian Federation, which prohibits an employer, when hiring, to establish probationary periods for citizens who graduated from higher institutions and secondary vocational schools less than 12 months ago. According to the Labor Code, a young specialist no longer has any benefits.

If we turn to the very concept of “young specialist”, then it is also not established in the Labor Code. Also it is not found in any other federal law... Only based on the content of regional regulatory legal acts, it is possible to single out main criteria for obtaining the status of a young specialist:

1. Age must not exceed 35 years. In some Russian regions this figure is 30 years.

2. Availability of an appropriate educational base:

3. After training and receiving a diploma, the first labor activity should be carried out at a public sector enterprise.

The provision of lump sum payments, benefits and other measures of social support for young specialists is established by sectoral agreements of the relevant departments. If we talk about non-state structures, then such social support will be carried out on the basis of local regulations of a particular enterprise.

If you want to receive detailed information about the benefits, during registration for work or immediately after that, you need to ask for the collective agreement of the enterprise for review. In addition, many organizations have regulations on the status of young professionals. These documents detail the working conditions of newly minted specialists, the number and amounts of payments, mechanisms for providing social benefits and other important points.

How old is the young professional status?

Maximum age threshold of a young specialist to receive the prescribed benefits is 30-35 years old. This indicator depends on the region where yesterday's student works. Since the conclusion employment contract the status will be legal for 3 years. The second time, this status cannot be obtained.

There are a number of cases when the status of a young specialist can be increased up to 6 years:

  • The specialist is undergoing postgraduate or postgraduate studies on a full-time basis.
  • During compulsory military service or alternative service.
  • A specialist is also located in childcare.

What are the measures to support young professionals

To date, there are no all-Russian measures for the social support of young specialists. Regulation of this issue occurs at the level of regional legislation. In most cases, assistance to young professionals is expressed in the provision of the following guarantees. This:

  1. Issuance of an interest-free loan for the arrangement.
  2. Upon employment, you can receive a lump sum payment.
  3. Subsidies or Or the specialist will be provided with corporate living space.
  4. Reimbursement of travel expenses - monetary compensation is paid.
  5. Reimbursement of the costs of paying for the maintenance of preschoolers in kindergartens in full or in part.

V this direction two budget spheres have priority: health care and education. For example, the Decree of the Government of Moscow No. 172-PP of 23.03.2004 in the current edition "On measures to provide teaching staff for educational institutions in Moscow" contains the following conditions for yesterday's student to receive the status of a young specialist:

  • Higher pedagogical or secondary vocational education.
  • Age must not exceed 35 years old.
  • The specialist must begin teaching activities no later than 90 days after receiving the diploma.

It is important to know that if a young teacher works in this area, but does not have a special education, then this does not serve as a reason for depriving him of the appropriate status. For example, a school teacher who has not yet turned 35 years old, who has a diploma in any profession that is not related to pedagogy, also has the right to apply for the title of a young specialist.

A lower age threshold has been set for teachers from St. Petersburg. In accordance with the law of St. Petersburg No. 107-27 "On measures of social support for employees of state educational institutions" dated 04/03/2007 (as amended in 2011), in this area, young specialists are teachers who are not older than 30 years.

To get the status of a young specialist, a school teacher from Saratov must also be no older than 30 years old. This issue can be clarified in the provision of the law Saratov region"On social support of young specialists of public sector institutions of the Saratov region" No. 96-ЗСО dated 03.08.2011.

It is important to know: if you are interested in receiving information on social support for young professionals in a certain region, then you need to contact the territorial division of the Department of Education at the place of work and your residence.

The health care system is less liberal in this matter: at the state level, benefits are provided for young medical specialists and social benefits only if they move to the countryside. If we refer to Law No. 326-FZ "On Compulsory Medical Insurance in the Russian Federation" dated November 29, 2010, physicians are entitled to receive compensation payments if the following conditions are met:

  • The age of a specialist does not exceed 35 years.
  • The employment contract is concluded for at least 5 years.
  • Official employment and residence must be in rural areas.

What are the benefits of a young education specialist

Similarly to the status, benefits and payments to young specialists of municipal educational and state institutions are established at the regional level. For example, in St. Petersburg and Moscow, this situation looks like this:

St. Petersburg

Young teachers of St. Petersburg are not provided with any wage supplements, but they have the right to receive one payment in the amount of:

  • 6 basic units - specialists who have a diploma of secondary and higher professional education can apply for them state standard;
  • 8 basic units - they can be counted on by specialists who received a diploma of the same level with honors.

As of 01.01.2015, the size of one basic unit is 8,432.00 rubles. In addition, during the initial 3 years of work, teachers in the northern capital, whose age has not passed the 30-year mark, are required to pay compensation for travel expenses of all types once a month. passenger transport within ½ cost. Taxis are an exception.

To receive such a payment, you should write an application and contact the social protection authority of St. Petersburg or the relevant department of education.

Moscow city

In the capital, young specialist teachers are given a one-time cash payment for official employment. In addition, in the first three years of employment, teachers are entitled to a wage supplement - it is 40% of the rate. If the specialist holds an honors diploma, then this indicator will be 50%.

Important information: the amount of surcharges and surcharges is calculated without taking into account additional workload. In other words, if a young teacher works at 1.5 rates, then the additional payment does not apply to the additional workload.

In addition, in the capital, a young specialist in education receives an additional supplement - 15% of the rate in order to compensate for ½ the cost of a travel ticket.

What assistance is provided to young healthcare professionals

Law No. 326-FZ for newly minted doctors who have moved to the countryside establishes compensation payments in the amount of 1 million rubles within the framework of the all-Russian social program "Zemsky Doctor". To receive this payment, you will need to conclude an appropriate agreement with the authorities local government at the place of employment.

This lifting payment is provided only to doctors (specialists) who have a diploma of higher medical education and work in their profile. But here one condition must be fulfilled - in order to provide monetary compensation, a young specialist-doctor must have worked in rural areas for at least 5 years. And if the doctor decides to quit, then he will have to return part of the amount that was previously paid to him.

The state, in addition to monetary payments, is obliged to provide young doctors with housing. This is possible in the following ways:

  • The specialist is provided with real estate for living;
  • You can offset part of the loan or
  • Provided land plot for housing construction.

It is important to know: a one-time payment of 1,000,000 rubles has a targeted nature and does not need to be taxed. The specialist must spend this money exclusively on improving living conditions.

For example, when the state reimburses part of a loan for the purchase of residential real estate, the remaining part is expected to be repaid from the funds that were paid under the Zemsky Doctor program.

Additional measures of social protection of medical workers in the regions

In many Russian regions, additional incentive measures... So, at the legislative level of the Pskov region, the list of those who have the right to additional payments includes representatives of the average medical staff... For them, one-time payments were assigned in excess of those provided for by federal legislation:

  • Paramedics and nurses - 30,000 rubles;
  • Doctors - 100,000 rubles;
  • Feldshers and nurses who work in feldsher-obstetric stations - 50,000 rubles.

Young doctors in Rostov region even before they receive a diploma, they begin to receive material support from the municipality. For 4-6 year students of Rostov Medical University, additional payments to the scholarship are established. And intern doctors have the right to receive a cash payment in the amount of 5,000 rubles every month as an increase in salary - this moment does not depend on the course of study.

Do not forget that detailed information on payments to young doctors and benefits in the regions must be obtained from the Department of Health and territorial divisions or in local governments. There you will also learn information about the procedure for their provision. It is important to know that if the region's budget does not have enough funds, then this cannot be a valid reason for refusing to provide cash payments.

In accordance with Article 48 of the Education Code of the Republic of Belarus, graduates who are provided with a job through distribution are provided with guarantees and compensation, in particular:

In the article, we will tell you who is considered a young specialist in the Labor Code of the Russian Federation, what benefits this status gives.

From the article you will learn:

Who is a young professional

Labor legislation does not provide an unambiguous explanation of the term “young specialist”. Nevertheless, it is actively used, including in official documents.

The basis is the wording from Art. 70 of the Labor Code of the Russian Federation. It says that some categories of workers are not assigned probation- including recent graduates of secondary vocational or higher educational institution within a year after receiving a certificate of education.

Different regions and industries may have different regulations that establish the requirements for the recognition of an MS employee.

Who is considered a young specialist in education

In the field of education, this term is used quite often, and there is no particular disagreement in its understanding. Small differences are related to the regional age limit (for example, in Moscow, "youth" is considered up to 35 years old, in St. Petersburg, Saratov - up to 30), sometimes training is required only at the budgetary department, there may be a time limit between graduation from an educational institution and getting started.

In a separate category, novice workers are allocated to increase the prestige of the industry and attract personnel to it. So, in pedagogy, a young specialist is considered an employee who is employed for the first time, who has not reached the age of 30-35, with a certain level of education - bachelor's, master's, secondary vocational. There are no criteria for gender or marital status.

After the assignment of the status of a young specialist, he is valid for three years. It can be extended by the same amount, but only in a few cases: when undergoing military service (alternative or military), studying in postgraduate or postgraduate studies, while on parental leave or maternity leave.

Status and related benefits cannot be reapplied.

In other areas

After education, the next area in which young people are supported as widely as possible is healthcare. In particular, if a graduate of a medical university is ready to move to a village or village for five years, he can take part in the Zemsky Doctor program. It entitles you to receive a tax-free payment to improve your living conditions.

Also, some regions have job quota programs for youth, which oblige managers to accept a certain percentage of recent graduates.

The status of a young specialist in labor law

The term itself remained from the time of the Labor Code, which ceased to operate in 2002. In the current legislation, it is not clearly defined, as are the benefits associated with the status. An exception is the absence of a trial period for employment. This gap is likely to be closed in the future.

During training on the program professional retraining"Organization of work with personnel" you will learn how to draw up personnel documentation according to the new rules, how to evaluate candidates and hire a new employee, how to implement professional standards and what to do if the qualifications of employees do not meet their requirements, and much more. Upon completion of the course, an official diploma awaits you.

Guarantees and benefits

What gives an employee the recognition as a young specialist? A certain number of guarantees and benefits that differ in different areas and regions. The most common of these are lump sum payments for employment, interest-free loans for settling, part reimbursement or 100% of the payment. kindergarten, preferential credit schemes or subsidies for home purchases, transportation compensation. To obtain accurate information, it is necessary to contact local government bodies.

For example, in Moscow, young teachers are entitled to a 40% bonus (if the diploma is "red" - 50%), an additional 15% is paid for moving by public transport, etc.

When the status of a young professional is lost

In most cases, the status "disappears" by itself, three years after receiving. If there were no circumstances due to which the validity period was extended for the same period. The same happens when changing the place of work, since the prerequisite for the first employment is canceled. The conditions under which a status is invalidated are described in regional and sectoral regulations.

The state and the regions establish benefits for young professionals, which are designed to motivate and help to find employment for citizens who have just graduated from various educational institutions. Benefits are designed to help find employment in companies of various levels. Benefits for young specialists, the rules for issuing, the status of a young specialist and the procedure for its provision - we will try to analyze all this and other aspects in detail in this article.

The nuances of lifting

The employer provides financial aid, which differs in the type of lifting means. The employer pays these funds in the first month after the contract with the employee has been concluded. The employer also "benefits" from this, since these funds are not taxed.

However, it should be borne in mind that these payments may affect the obligations of the parties, namely the obligation of the employee to work in the organization for a certain period of time.

Important! This can be from three to five years.

In the case when a specialist is employed in an organization not where he lives, then he should be provided with the following:

  • reimbursement of travel expenses;
  • reimbursement for travel to work of all family members of the employee;
  • daily allowance according to the number of days on the road;
  • average salary for the same period of time.

The lift is granted once or paid every year for three years. You need to find out about all the procedures for payment of lifting benefits from the authorities at the place of employment.

Important information! Young professionals should receive compensation in the form of Money during the first month of employment. The amount of funds paid is influenced by the position and place of employment. The project is designed to motivate new specialists to work in their profession.

In the event that an employee wants to relocate, no refunds will be provided to him. According to the actions, which are aimed at distribution, the specialist will go to the place where he permanently resided before studying at the university.

Who has the right to receive this status based on the laws of the Labor Code of the Russian Federation?

If we talk about our days, then there is almost no regulation at the government level of the status of a young specialist. Benefits are also not federally regulated. All that is in the legislation on this topic is information in article 70 of the Labor Code of the Russian Federation, which states that it is forbidden to determine the period for passing tests for employees who graduated from secondary specialized or higher educational institutions less than a year ago. There are no other concessions for young specialists in the Labor Code of the Russian Federation.

Also, there is no definition of "young specialist" in federal documents. Only based on the regulatory legal acts of regional legislation, it is possible to somehow determine the criteria for obtaining this title:

  • age limits - up to thirty-five years (in some regions, these levels may be limited to thirty years);
  • whether a citizen has any education that was received in full-time education in educational organizations with state accreditation (in some regions, they may also require training on a budget);
  • the first employment in a budgetary company after receiving higher education.

The procedures for the provision of benefits, one-time payments and other measures of social support for young employees are regulated by sectoral agreements of the relevant departments.

Important! If we talk about non-governmental institutions, then the support is implemented on the basis of local documents of organizations.

One way or another, after the young specialist finds a job, all necessary information it will be necessary to learn about the indulgences due to him from the collective agreement of the organization. Also, many enterprises have various procedures that are relevant to young specialists - the documents clearly define the terms and conditions of work for newly arrived employees who were recently students. In the same documents, you can find out about the amount of payments, issuance procedures, and more.

What are the age restrictions for the “young specialist” status?

The age limits for young citizens who are eligible for benefits are limited to thirty to thirty-five years. Everything is decided by the area where young people will work and receive wages... The status is valid for 3 years after the contract with the employee has been concluded, and the status cannot be reassigned.

In some cases, the status can be extended up to six years:

  • while serving in the armed forces of the Russian Federation;
  • when studying in graduate school;
  • in case of being on maternity or childcare leave.

Measures taken to support a young specialist, payments

At the moment, there are no measures that would be taken at the national level to support a young specialist. Today, all orders for this status are carried out at the expense of regulations in the regions. Usually, assistance is provided through the following guarantees:

  • one-time payments when applying for a job;
  • reimbursement of funds for transport costs of citizens;
  • various subsidies and benefits for the purchase or construction of real estate. Sometimes they give out corporate real estate;
  • loan without interest for the arrangement;
  • full or partial reimbursement of funds for the maintenance of children in preschool institutions and so on.

Important! The priority areas in this area will be the following: education and health.

If a citizen does not have special education, this does not mean that he does not have this status when carrying out labor activities in these areas. For example, a teacher at a school who is not yet thirty-five years old and who has a diploma in any specialty that is not even related to pedagogical activity is also entitled to apply for this status.

By the way! For teachers from the city of St. Petersburg, the age limit is lower - based on the legislation of the region, young specialists in this field are citizens who have not reached thirty years of age.

Similar age limits are set in the Saratov region.

It is worth knowing that all information about social support for young teachers in a particular region can be found in the offices of the Department of Education at the place of work.

In the health sector, the rules are even stricter: the state provides for social payments and various concessions for young specialists - doctors, only if they move to the countryside. According to the law, healthcare providers will receive a refund if they meet the following requirements:

  • age up to thirty-five years;
  • employment and residence in rural areas;
  • the contract was concluded for a period of more than five years.

Young specialist in the field of education. Relief and financial assistance.

Regions establish all procedures for payments and benefits for young specialists of educational institutions of different levels. For example, in the cities of federal significance - Moscow and St. Petersburg - the following procedures apply.

Moscow

In addition to a one-time payment when applying for a job, new teachers for the first three years of work are entitled to receive an increase in salary in the amount of 40%. For employees with honors, this increase is higher - 50%.

In addition, in the city of Moscow, young specialists working in the educational field receive another type of additional payments - 15% of the rate, which compensates for half of the cost of a travel ticket.

Important information! The amount of increments and surcharges is taken into account without additional burden. For example, if an employee works at 1.5 rates, then he will receive all additional payments for one.

Saint Petersburg

In St. Petersburg, young specialists working in schools do not receive bonuses, since they are not provided for by the region, but they are entitled to receive one-time payments in the amount of:

  • six basic units - for employees who have a state diploma on training in a secondary or higher educational institution of vocational education;
  • eight basic units - for employees who have the above diploma, but with honors.

As of January 1, 2019, the size of one basic unit is 11,610 rubles.

In addition, young specialists of the northern capital who are under thirty will be reimbursed 50% of the cost of travel on any type of passenger transport, except for taxis.

Important! One-time payments are provided to citizens who have written an application to the Department of Education or the body of social protection of the population.

Support for young healthcare professionals

The law establishes compensation for young healthcare professionals who have moved to rural areas. They are entitled to payments of a million rubles. The funds are paid within the framework of the Zemsky Doctor social program. To receive payment, you need to conclude an appropriate agreement with the authorities at the place of employment.

These funds can only be obtained by doctors, i.e. specialists who have higher education in the field of medicine and work in their specialty. The main rule in order to receive payment is the period of labor activity of a young specialist in five years in the countryside. If the employee decides to leave work earlier, then he will have to return part of the funds.

In addition to providing cash, the government must also provide housing to professionals by:

  • issue of housing;
  • the issuance of land to citizens for the construction of real estate;
  • providing reimbursement of part of the funds for a loan or loan for the purchase of real estate.

Important information! Vase payments in the amount of one million rubles have a special purpose and are not subject to tax. These funds are intended only to improve living conditions. For example, there is a part of the loan funds paid by the state, these funds can be used to cover the rest. The funds are provided through the Zemsky Doctor program.

Additional social protection for medical workers in the regions of the Russian Federation

In many regions of the Russian Federation, the authorities have established additional privileges for medical workers who have found employment in rural areas. For example, in the Pskov region, nurses are also encouraged, who are provided with one-time payments.

In Rostov, young doctors receive support in the form of money even before they are awarded a diploma: additional payments and scholarships are awarded to students from the fourth to sixth year of Rostov Medical University. Interns, in turn, have the right to receive payments in the amount of five thousand rubles every month - this is a supplement to the salary. The year of study does not matter.

It is important to know that all necessary information by the types of benefits provided and payments that are due medical professionals in the regions of the Russian Federation, and the rules for obtaining them should be found out from the self-government bodies or health departments.

Important! If the budget does not have funds, then even this is not a reason for not issuing payments to health workers.

Motivating funds

In the event that a health worker is sent to a rural area during assignment, motivational funds will be paid to him for three years.

The amount of funds paid to health workers is regulated at the regional level, like other types of benefits.

On average, the price of a motivational benefit is one million rubles.

This right is granted to citizens who are specialists in the field of science and health care and only if the conditions for distribution for employment in an appropriate place are met.

Important! If a citizen refuses distribution, he will be denied support from the state.

Payments to teachers

Lifting means, which are intended for specialists in the field of pedagogy, vary in the amount from twenty to one hundred thousand rubles. These funds will be paid if the teacher carries out labor activity in the state high school... The amounts paid are also subject to regional adjustment. As expected, the most expensive subject is the city of Moscow, where citizens are paid funds in the amount of 100,000 rubles. In St. Petersburg, this amount is equal to fifty thousand rubles.

Agricultural specialists

Payments in the form of lifting funds for young specialists in the field of Agriculture... In the Russian Federation, there is a program called “Young specialist in rural areas”. Thanks to the implementation of this program, the government wanted to immediately solve many problems associated with attracting young specialists to work in rural areas and solving the problems of young citizens related to housing.

There are several limitations to consider:

  • the age of citizens should not exceed the bar of thirty-five years;
  • specialists must have higher education;
  • citizens should not have their own housing;
  • the conditions that young specialists have do not correspond to the optional standards that are established in the Russian Federation;
  • young professionals must live in rural areas or intend to move to rural areas for permanent residence.

Important! Young specialists who are ready to take part in this program can expect to receive considerable funds. However, it is worth knowing that the amounts vary and are regulated at the regional level.

The amount that is offered to a young specialist should be enough to buy a property or make a major overhaul in a home.

For the fact that young specialists received these funds from the state, they must work in rural areas for at least five years in the specialization that they studied at a higher educational institution. If a young specialist at any stage refuses to participate in the program, then various punishments will be imposed on him, up to the confiscation of property.

It is worth remembering that receiving elevators is not the same as slavery. Young specialists have the right to quit their jobs earlier than the term stipulated by the program. In such circumstances, the young specialist will need to return an amount that will be equal to what has already been spent.

Employees of the Russian Railways

Students of higher educational institutions who are preparing to become employees of Russian Railways will receive support from the state in their distribution.

This year, this support includes:

  • reimbursement of funds for the move;
  • reimbursement of funds that were spent on renting real estate in a new place of employment;
  • one-time payments in the amount of one salary in the specialty;
  • daily allowance.

Important! There are no additional motivating payments at the state level. The regions may have various programs, which are implemented to support young specialists involved in the field of railways.

For example, a regional program is being implemented in Penza, where after a young specialist has worked for a year, he will be paid two salaries. Thus, the region encourages the young specialist and encourages him to work even harder.

Other indulgences

Based on the Labor Code of Russia, teachers may be provided with some types of benefits:

  • the duration of the vacation can be from forty-two to fifty-six days. In the event that a teacher works without rest, then he has the right to take labor leave for up to a year;
  • the number of hours in working weeks is less than thirty-six;
  • funds are allocated every month for the purchase of literature;
  • early retirement.

For teachers who carry out labor activities in rural areas, there are also benefits:

  • they are paid an increased salary;
  • teachers have indulgences when paying for utility bills.

In rural areas, there is a severe shortage of highly qualified young specialists. However, young citizens do not want to work there due to the fact that in rural areas there is a very low salary, and there is often no housing there.

Important! In view of the above factors, the government is implementing various measures to support young teachers who have found jobs in rural areas.

Also, benefits exist in the form of support for the purchase of housing and with a loan, where part of the real estate is paid for at the expense of state funds. Moreover, the specialist will receive housing without queues if he moves.

Mortgage issues

Today it is quite difficult to buy your own home as a young professional. The state cares about young personnel, but not to the extent that they do not need to worry about housing at all. Therefore, a mortgage on preferential terms would be a good way out, where part of the funds is provided from the state budget. This type of assistance is implemented both by the state and by enterprises that want to attract young specialists to work.

Important! Today, there are positive changes in the provision of mortgages, but the circumstances are such that not all organizations in the country have the ability to help young specialists with the repayment of the mortgage component, and the state cannot yet fully address this issue.

Last changes

V Lately a number of changes have taken place in terms of assistance to young specialists. Earlier, there were various programs in the regions to provide housing for teachers, but today they have been canceled.

Last year, the implementation of the Zemsky Doctor program was transferred to the Ministry of Health. This means that all the money is now allocated from the budget. Also, from 2020, the Zemsky Teacher program will be launched.

Mortgage programs were also transferred to the regions. Interest rates are constantly being reviewed.

Conclusion

Unfortunately, at the federal level, there are no benefits and payments for young specialists, but they are available in the regions. The government of each constituent entity of the Russian Federation independently decides how to help young people who have received higher education in finding a job and obtaining housing. The help is often significant, and people can get stable jobs without needing money.

Do not forget about the federal program "Zemsky Doctor", under which the state will pay a million rubles to people who decide to work in rural areas. The "Zemsky Teacher" program with similar conditions will be launched soon, and this is a good chance for young people to get a job at high-paying job without worrying about the lack of housing.
